Terms of Service

By registering for and using Sibol, you agree to these Terms of Service. Please read them carefully before creating your account.

1. About Sibol

Sibol is a cloud-based point-of-sale (POS) and retail management system developed and operated by Lykha Solutions, a Philippine-based software developer. Sibol is designed for cafes, retail stores, and similar businesses operating primarily in the Philippines.

3. Account Registration and Approval

All store registrations are subject to review and approval by Lykha Solutions. Submission of a registration form does not guarantee activation. We reserve the right to reject any application at our sole discretion.

Upon approval, you will receive a welcome email with your store login link. You are responsible for maintaining the confidentiality of your login credentials.

3.1 Account Security

You are responsible for all activity that occurs under your account. You must notify us immediately at hello@lykha.solutions if you suspect unauthorized access to your account.

4. Subscription Plans and Payment

Sibol offers three subscription tiers:

Payment for Standard and Pro plans is processed via bank transfer or GCash. Plan upgrades are handled manually by contacting hello@lykha.solutions. Subscriptions are non-refundable once activated.

4.1 Plan Expiry

Upon plan expiry, your account will be downgraded to the Free tier. Your data will be retained for 90 days after expiry. Lykha Solutions reserves the right to modify pricing with 30 days notice.

Violation of these terms may result in immediate account suspension without refund.

6. Data and Privacy

All data you enter into Sibol — including products, customers, orders, and transaction records — belongs to you. We process this data solely to provide the service and do not sell it to third parties.

7. Service Availability

Sibol is provided on an "as-is" basis. We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

Lykha Solutions is not liable for any loss of revenue or data resulting from service downtime.

8. Intellectual Property

Sibol, its design, code, and branding are the intellectual property of Lykha Solutions. You may not copy, resell, or redistribute the software without written permission.

Your business data, product catalog, and customer information remain your property at all times.

9. Termination

You may cancel your account at any time by contacting us at hello@lykha.solutions. Upon cancellation, your data will be retained for 30 days before permanent deletion.

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice.

10. Limitation of Liability

To the maximum extent permitted by Philippine law, Lykha Solutions shall not be liable for any indirect, incidental, or consequential damages arising from your use of Sibol. Our total liability shall not exceed the amount you paid for the service in the last 12 months.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify registered store owners via email at least 14 days before significant changes take effect. Continued use of Sibol after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved in the appropriate courts of Baguio City, Philippines.
